Arrested. Now What?
Friday, 29 December 2006

First, you need to gather the information available to you in order that a qualified, experienced DUI trial lawyer can evaluate your case.  Beware of plea lawyers who offer discount legal fees and little or no service.  There are literally thousands of diiferent defenses to any given DUI case.  None of the defenses can be discovered without a careful review of at least the uniform traffic citation, accident report, police incident report, dui incident report, dui supplement report, 911 tape, arrest video tape,  and/or intoxilyzer video tape, depending on your jurisdiciton.  At  $250 dollars per hour, a competent lawyer can not meet with the client, attend court, and competently investigate your case in two hours.

Second, a seven year driving history from the Georgia State Patrol and a criminal history from the Georgia Criminal Information Center (GCIC) can be important to deciding on an appropriate strategy.

Third, what can I do?  Hire a competent DUI lawyer.  For repeat offenders, immediately attend and document Alcohoiics Anonymous meetings and obtain a drug and alcohol evaluation from a qualified psychologist.  DUI School is usually a good idea for first offenders.  A DUI school certificate can be useful in the circumstance of an administrative license suspension before trial.

Fourth, photograph the scene of the arrest in order to discover discrepancies in the police report regarding the stop and reasonableness of the field evaluations like the one leg stand and the walk and turn.

Fifth,  request a hearing with the Department of Driver Services within ten business days to prevent an administrative license suspension after 30 days.

Sixth, Hire a competent DUI lawyer.  You should never attempt self-representation in a DUI case.  Georgia DUI law is very complicated even for lawyers and full of surprises for the self-represented.
