Busta Rhymes was arrested on May 3rd, 2007 for suspicion of DUI in Manhatten. According to Busta, all this mess over one little shot of
Hennessy before he took the wheel of his Denali. The "popo"claims that Busta had watery and bloodshot eyes (who doesn't after midnight), failed a field sobriety test (more than one in five sober people do according to the cops own studies-might as well flip a coin), and he blew a 0.067, below the legal limit
of 0.08. He was charged with the equivalent of a less safe driver DUI under Georgia law. He was released on $7,500 bail. It will be very difficult for Busta to be convicted of a DUI less safe at 0.067 as he should look sober anywhere under 0.12 and lets face it the legal limit is the legal limit and he is under it. The war on social drinking is on! Prosecutors will probably leverage this weak DUI charge to force a plea in the assault case. They have offered a year in jail for a plea! That's ridiculous. I smell a jury trial. Remember all Defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law. Interesting note: it appears that in New York you don't have to be in actual physical control of a moving vehicle as in Georgia. A running engine and behind the wheel is enough. There is not moving violation that could have justified a traffic stop in the charging documents.
