Bibb County Sheriff testifies for DUI Defendant and MADD reacts angrily
Bibb County Sheriff Jerry Modena testified for a DUI Defendant in Macon on March 17, 2009. He testified that the DUI Defendant was a friend of his and did not appear intoxicated or have slurred speech. The DUI Defendant blew .164 on the Intoxilyzer 5000. The Bibb County Sheriff testified that he trusts the "instrument" when it is working properly with all of its parts attached. He did mention that older versions of the machine could be manipulated by the operator but that this was supposed to be the best machine on the market today. He also noted that the Intoxylzer 5000 was sent to its manufacturer for maintenance 2 months after the Macon DUI Arrest.
