Cobb County DUI Officer suspended for striking handcuffed man

On April 16, 2009, Channel 2 Action New reported that a Cobb County Judge determined that insufficient probable cause existed issue a simple battery warrant against a Cobb County DUI police officer who admitted to slapping a handcuffed DUI arrestee. The judge was quoted as saying that the officer had been punished enough by being suspended him for 15 days without pay.  The individual arrested for DUI, Danny Lackey, who maintains his innocence, applied for a warrant because he wasn't satisfied with just a suspension. 
The Officer reported questioned Lackey, "Do you have a ... problem?"  Lackey responded, "As a matter of fact, I do."   Lackey claims the Officer then struck him in the side of the head. Officer K.W. McClure admitted hitting Lackey in an internal investigation and was suspended without pay.  McClure contends that it was only a slap.
