Lawrenceville Police Investigator fired after DUI accident in Gainesville, Georgia
Lawrenceville Police Investigator Stuart Gaines was involved in an accident on the weekend of November 22-23, 2008. He left the funeral of a retired officer and two hours later was involved in an accident near Gainesville. Police reported that he smelled of alcohol, his speech, and his demeanor suggested that he may be under the influence of alcohol. Curiously, media reports included no mention of field sobriety tests or submission to state administered chemical testing of his blood, breath or urine. The Officer's Lawrenceville supervisor met the Georgia State Patrol at the scene. He was fired on Monday allegedly because officers are held to a higher standard. This arrest should be instructive to others arrested for DUI that when police officers are arrested they refuse field tests and breath, blood and urine tests. Why would you do something the police won't do themselves? The other driver was injured and complained of back pain. A serious injury such as loss of consciousness or a fracture or broken bone can turn a ordinary misdemeanor DUI into a felony offense DUI with Serious Injury resulting in 1 to 5 years in state prison. Remember all Criminal Defendants even police officers are innocent until proven guilty beyond a reasonable doubt by a jury of their peers.
