The Manufacturer of Intoxylzer 5000 and Minnesota reach backroom settlement of source code secrecy
sideviewbtmachineMedia outlets are reporting that CMI, Inc. and the State of Minnesota reach a backroom settlement of the Intoxylzer 5000 Source Code lawsuit.  CMI has maintained that its Intoxylzer 5000 source code is a trade secret and not subject to court review by Criminal DUI Defendant and those seeking to challendge Civil Administrative DUI License Suspensions.  The State of Minnesota agreed and sued.  A settlement agreement announced on June 1, 2009 that has taken some by surprise.  The agreement pledges that CMI will release the source code specific to the State of Minnesota to the State, will provide up to $50,000.00 for independent review of the source code for State Prosecutors, and allow certain authorized State and Defendant's Attorneys and their experts to review the source code on site in Kentucky.  Attorney's claim this is just more smoke and mirrrors.  The Federal Judge overseeing the case still has to approve the settlement.
