In May 2007 Teresa Jean Spann was arrested for DUI. She was convicted after a bench trial in August of 2010. She appealed her conviction, contending that the trial court erred in allowing the admittance of similar transaction evidence and in denying her the issuance of an out-of-state subpoena. Though the Court rejected her argument over similar transaction evidence, it remanded the case to the trial court to reconsider the subpoena issue in light of Davenport v. State (2011). The trial court reviewed Spann's case and again found Spann was not entitled to subpoena an out-of-state witness. In light of the Georgia Supreme Court's grant of certiorari in Cronkite v. State, S12C1927 (Nov. 2012) – a similar case to be reviewed in the framework of “'whether the Court of Appeals properly applied Davenport v. State (2012)'” when granting the issuance of an out-of-state subpoena - the Court of Appeals adopted this same framework to address Spann's second appeal. more
A Fayette County DUI is Serious and Can Result in Jail Time, Fines, and Lengthy License Suspensions:
Under Georgia law, for a first DUI you can be fined up to $1000.00 with up to 40% tacked on as court costs, spend up to 12 months in jail, do 40 hours community service, be subject drug and alcohol testing for one year, and serve 12 months of reporting probation. On top of all that, your license can be suspended anywhere from 120 days to 5 years. Do not go to court without an experienced Fayette County DUI Attorney.

Client was in a single vehicle accident near Highway 270 and Helmer Rd. Client was in a friend's car ready to leave the scene when an officer arrived. He approached the passenger side of the vehicle and notice the odor of an alcoholic beverage and vomit emitted from our client. When asked to perform field sobriety tests, our client was uneasy on her feet. The officer then noticed what looked like vomit on our client's person. Client failed the Horizontal Gaze Nystagmus (eye test), Walk and Turn, and One Leg Stand field sobriety tests. A hand-held breath test gave a positive result for alcohol ingestion. Client was arrested, refused any further tests, and was charged with DUI less safe and failure to maintain lane in Fayette County State Court. more
