CASES OF NOTE - OTUWA v. STATE - A12A1382: The Limits of Charging Lesser Included Offenses For First-Degree Vehicular Homicide
The record shows that Otuwa Otuwa was in a single-vehicle accident on a residential road on August 3, 2008. He lost control of his car, crashed through a stop sign and street sign, veered off of the road, and flipped multiple times. Otuwa's sister and another passenger were thrown from the vehicle and died of their injuries. Otuwa and a separate passenger survived. Reportedly, Otuwa smelled strongly of alcohol and his eyes were red and glassy. A preliminary roadside breath test showed that Otuwa had been drinking and returned a numerical result of .175 BAC. A further investigation showed that he was traveling at approximately 93 mph at the time of the accident. He was arrested and charged with two counts each of first-degree vehicular homicide by less-safe DUI, by per-se DUI, and by reckless driving, and less-safe DUI, per-se DUI, and reckless driving for a total of nine counts. more
A Brookhaven DUI is Serious and Can Result in Jail Time, Fines and License Suspensions - DO NOT Opt to Represent Yourself:
Under Georgia law, you can be fined up to $1000.00 with up to 100% tacked on as court costs, spend up to 12 months in jail, do 40 hours of community service, be subject to drug and alcohol testing for one year, and serve 12 months of reporting probation. Your license can be suspended anywhere from 120 days to 5 years. Do not try to handle your DUI without an experienced Brookhaven DUI attorney.

Brookhaven Municipal Court Information. On August 1st, 2014, the Brookhaven Municipal Court will move from its current location and begin conducting court sessions on the first floor of the Brookhaven Police Department at 2665 Buford Highway, Brookhaven GA, 30328. The City Solicitor in Brookhaven is Bill Riley of Riley McClendon LLC in Marietta. Mr. Riley and his law firm act as the Prosecuting Attorneys at Brookhaven Municipal Court. Your first court appearance will be an arraignment. It is at this Court appearance that generally you either plead guilty, not guilty or ask for a pre-trial conference with the City Solicitor to obtain a recommendation of punishment or work out reduced sentence like a Reckless Driving. Reckless Driving reductions are not easily obtained in Brookhaven Municipal Court but are possible. If you are not happy with the plea recommendation offered by the Prosecuting Attorney, you have two choices. You must either waive your right to a jury trial and have a trial of your guilty before a Judge in Brookhaven Municipal Court. Brookhaven Municipal Court does not have jurisdiction to conduct jury trials. Alternatively, you can request a jury trial in which case your charges will be bound over to the State Court of DeKalb County where the process will begin all over again including another arraigment, motion hearings, calendar call and either a judge only trial or a jury trial of six jurors selected from the community jury rolls.
