In Georgia, DUI penalties vary by offense level and factors like BAC, age, and priors. For a first DUI (over 21, within 5 years): Fines $300–$1,000 plus up to 100% in court costs, up to 1 year jail (minimum 24 hours), 40 hours community service, DUI Risk Reduction Program (school), clinical evaluation if needed, and 120 day license suspension (eligible for limited permit with conditions). Second offense: Fines $600–$1,000 plus 100% in court cotst, 90 days–1 year jail (minimum 72 hours), 240 hours or 30 days community service, 18-month suspension (hard no-drive for 120 days, then IID for 8 months). Third offense: Fines $1,000-$5000 plus up to 100% in court costs, up to 1 year jail (minimum 15 days), 240 hours or 30 days community service, DUI Risk Reduction Program (school), clinical evaluation if needed, and 5 year license suspension (eligible for limited permit with Ignition Interlock Device after 2 years). Fourth or more: Felony status with harsher penalties, including 15 days minimum jail and up to 5 years suspension. Under 21 or commercial drivers face stricter zero-tolerance rules with a legal limit of 0.02 or one alcoholic beverage or less.
Georgia DUI Court Procedures
After a DUI arrest in Georgia, the process involves two tracks: criminal court and administrative license actions. You'll receive a citation and be released on bond. The case proceeds to arraignment, where you plead (not guilty recommended). Discovery follows, allowing evidence review of videos, scientific reports and police reports. Motions to suppress or Motions in limine evidence (e.g., improper stop) can be filed. If unresolved, it goes to trial (bench in Cumming Municipal Court or a jury trial in Forsyth County State Court). Plea deals are possible, either minimizing DUI punishment or in some cases reducing to reckless driving or another lesser included traffic offense.
