Fulton County Solicitor to Retry DUI Case After Atlanta News First Investigation: What Atlanta Drivers Need to Know

The Case That Caught Atlanta’s Attention

In August 2023, during a block party in Atlanta’s Bankhead neighborhood, a white BMW rolled over an embankment and struck pedestrian Cierra Geter. The impact was severe: Geter suffered a concussion, three broken ribs, glass embedded in her body, and displacement in her lumbar and cervical spine. She spent eight days in Grady Memorial Hospital and continues to deal with ongoing pain and medical treatment.

Both the driver, Anichia Tripp (who had a prior DUI conviction from 2012), and the passenger, Jabbar Rahman, were charged with misdemeanor DUI. Body camera footage reportedly captured Rahman admitting they had been drinking, saying, “We was in the car intoxicated. We drunk, bro.”

Despite the serious injuries and admissions on video, the Fulton County Solicitor General’s Office initially dismissed Rahman’s charges “in the best interest of justice” and declined to prosecute Tripp, citing difficulty proving she was awake and in control of the vehicle. The Fulton County District Attorney’s Office also declined to pursue felony “serious injury by vehicle” charges.

That changed after Atlanta News First requested the body camera video and case file. Just days later, the Solicitor’s Office announced it would retry the case against Rahman. The victim received a personal apology from the office, which reportedly admitted it had “dropped the ball” until the evidence was re-examined. Tripp’s charge was reduced to reckless driving.

This case is a textbook example of several important realities in Georgia DUI defense:

  • Prior DUIs matter. Tripp’s 2012 conviction likely played a role in how her case was viewed, even if she ultimately faced a lesser reckless driving charge.
