There are Two Different Courts, Two Separate Suspensions, and the Ten-Day Letter. After a Georgia DUI arrest, if your breath or blood alcohol registers over .08 within three hours of driving, or you refuse a state administered chemical test of your blood, breath or urine, Georgia DUI law requires that you be issued a Georgia Department of Driver Services (DDS) Form 1205 as well at a Criminal Court summons or a Uniform Traffic Citation for DUI. The DDS Form 1205 is a 30 day temporary driver's license, but it is also a notice of intention to suspend your driver's license, as the arresting officer has sworn that he had reasonable grounds to arrest you for DUI. more

In May 2007 Teresa Jean Spann was arrested for DUI. She was convicted after a bench trial in August of 2010. She appealed her conviction, contending that the trial court erred in allowing the admittance of similar transaction evidence and in denying her the issuance of an out-of-state subpoena. Though the Court rejected her argument over similar transaction evidence, it remanded the case to the trial court to reconsider the subpoena issue in light of Davenport v. State (2011). The trial court reviewed Spann's case and again found Spann was not entitled to subpoena an out-of-state witness. In light of the Georgia Supreme Court's grant of certiorari in Cronkite v. State, S12C1927 (Nov. 2012) – a similar case to be reviewed in the framework of “'whether the Court of Appeals properly applied Davenport v. State (2012)'” when granting the issuance of an out-of-state subpoena - the Court of Appeals adopted this same framework to address Spann's second appeal. more

Under Georgia law, you can be fined up to $1000.00 with up to 40% tacked on as court costs. You can spend up to 12 months in jail for a first DUI, do 40 hours community service, be subject to drug and alcohol testing for one year and serve 12 months of reporting probation. After a DUI arrest in the City of Jonesboro, Georgia, your first court appearance will be scheduled in the City of Jonesboro Municipal Court. The Jonesboro Municipal Court is a court of limited jurisdiction. No jury trials are held at the Municipal Court and any demands for jury trials must be bound over to the Clayton County State Court. The Jonesboro Municipal Court can only hear certain limited crimes including traffic offenses, shoplifting, DUI, misdemeanor marijuana possession less than one ounce and city ordinance violations.
