Serious Injury by Vehicle and DUI equals 15 years in state prison
March 16, 2011: New media sources reported that a Gwinnett County DUI driver drover her car off the road injuring her two children ages, 16 and 8, who were taken to Children's Healthcare of Atlanta. The female driver registered a .112 on the Georgia State Administered Breath test which is over the legal limit of 0.08 for DUI in Georgia. She was arrested by Gwinnett County Police. She will be facing misdemeanor charges for the DUI per se (over the legal limit of 0.08), DUI less safe (driving while impaired), 2 counts of DUI Child endangerment, and felony serious injury by vehicle. She will be subject to a 5 year license suspension as a habitual violator suspension for having three or more serious traffic charges in 5 years as the DUI and 2 Child Endangerment DUIs will be counted against her if convicted. If the charges do not merge, each DUI can result in one year in jail and the felony serious injury by vehicle can be up to 15 years in state prison. This is true even for a first offense.
